Regulatory Update: Tea Tree Oil in Cosmetic Formulations (EU and UK)

Introduction

There has been ongoing discussion regarding the classification of Tea Tree Oil (Melaleuca alternifolia) within cosmetic products.

Given the level of industry attention and the popularity of this ingredient in depilatory waxes, we want to provide a clear and measured update on the current regulatory position and what it means in practice.


Current Position in Great Britain: No change

Tea Tree Oil remains approved for use in cosmetic products in Great Britain.

The HSE has confirmed that it will not adopt the proposed Reproductive Toxicity Category 1B classification, meaning there are no changes required to existing formulations.

Current usage levels and applications can therefore continue as normal.

Confirmed Safe Use

The Scientific Committee on Consumer Safety (SCCS) has confirmed that Tea Tree Oil is safe for use in rinse-off cosmetic products up to a concentration of 2%.

This supports its continued use as an anti-septic and anti-inflammatory ingredient within cosmetic formulations.


Current Position in EU: Under Review

At EU level, discussions remain ongoing following the RAC opinion proposing a Category 1B classification .

At this stage:

  • No final decision has been made
  • No regulatory change has been implemented
  • Tea Tree Oil remains permitted for use

Any future changes would be subject to formal adoption by the European Commission and would include a defined transition period.


What This Means in Practice

There is no immediate requirement for reformulation or product change.

For UK-based manufacturers and brands, Tea Tree Oil remains fully compliant.

For those supplying into the EU, it is sensible to remain aware of developments, but no action is currently required.
